About this agreement
This agreement is between you and Omnibus, Ltd ("we", "us"). It covers the DuckCarry desktop application for macOS and Windows, including its updates, its documentation and the page it shows on your phone for Wi-Fi transfers. By installing or using DuckCarry you agree to it. If you do not agree, do not install or use DuckCarry.
If you accept this agreement on behalf of a company or other organization, you confirm that you are authorized to do so, and "you" means that organization.
Free version and full version
Without a license, DuckCarry copies and checks a limited number of photos and videos, as shown in Settings > License, and every safety feature is included. The free version stays free, with its limits. A license, bought once, removes that limit for the major version you bought. There is no subscription.
License grant
We grant you a personal, non-exclusive, non-transferable license to install and use DuckCarry on the number of computers you bought it for, as stated in your order, Mac, Windows or both, for the major version you bought and its minor updates. One license key works on macOS and Windows. A later major version may be a separate purchase; we are not obliged to release one.
Activation
Activating a license key needs an internet connection, and each activation uses one of the computers your license allows. To activate, DuckCarry sends your license key and a randomly generated label for the computer (such as "Mac 3f9a", never your name or the name of your computer) to our license provider, Lemon Squeezy. While a license is active, DuckCarry checks with Lemon Squeezy about once every seven days that the key is still valid; if it cannot reach Lemon Squeezy, it keeps working for up to 14 days after the last successful check. To move the license to another computer, choose Settings > License > Remove license from this computer on the old one, then enter the key on the new one. If you no longer have the old computer, contact us and we will free its activation.
Mac App Store edition
If you got DuckCarry from the Mac App Store, any purchase you make there is made with Apple, is governed by Apple's terms and is refunded by Apple under its own policies. Your use of the Mac App Store edition is governed by this agreement where Apple's terms allow a developer's own license agreement, and otherwise by Apple's standard Licensed Application End User License Agreement. A license key bought on our website does not unlock the Mac App Store edition.
Restrictions
You may not sell, rent or lend DuckCarry or a license key, share a key beyond the computers it allows, remove or get around the license checks or the limits of the free version, or reverse engineer DuckCarry except where the law allows it despite this restriction.
Your photos and backups are your responsibility
DuckCarry copies photos and videos from phones (iPhone and Android), cameras and memory cards to the folders and backup drives you choose, and reads each copy back to check it. Copying never removes anything from the phone, camera or card. A checked copy shows that the copy matched the original when it was checked; it does not protect against a later drive failure, power loss, malware or a mistake. Keep the originals on your phone, camera or card until you have checked the copies, and keep an independent backup of anything you cannot afford to lose. JPG and MP4 versions that DuckCarry makes are new files, not the originals.
Freeing up space on a phone removes photos and videos from it only after you confirm twice, and only those whose original copies have been checked on your computer. What is removed from a phone may not be recoverable; do not rely on the phone's trash. Wi-Fi transfers never remove anything from a phone. You must have the right to copy the photos and videos and to use the devices you connect.
Optional Wi-Fi receiver
The Wi-Fi receiver runs only when you start it. It opens a temporary, encrypted service on your computer so that a phone on your own network can send photos and videos to it. Use it only on networks you trust, and check the certificate fingerprint shown in the app before you enter the pairing code. A phone's file picker may send a converted copy instead of the original in its library.
Updates
Updates may add, change or remove features.
Privacy
DuckCarry works on your computer. It does not upload your photos, videos or their locations to us or to any cloud service. It connects to the internet to activate and check a license (section 3) and, when you show a map, to load map tiles from CARTO and OpenStreetMap, which see the area you view. It also sends error reports to Sentry (Functional Software, Inc., USA): crash reports always, other error details only while Settings > Photos & privacy > Send diagnostics is on. Sentry also receives the IP address of the computer that sends a report. Error reports never contain your photos, videos, the names of your files, folders or phones, or your license key. How DuckCarry handles information is described in the DuckCarry Privacy Policy, which is part of this agreement.
Open-source components
DuckCarry contains open-source software under its own licenses, listed in Settings > Legal > Third-party licenses. Those licenses apply to those components, and nothing in this agreement limits your rights under them.
Ownership
DuckCarry is licensed, not sold. We and our licensors keep all rights not expressly granted to you. The photos and videos you copy with DuckCarry remain yours.
Payment and refunds
Licenses bought on our website are sold by Lemon Squeezy, which acts as our reseller and merchant of record; prices, taxes and payment are handled under Lemon Squeezy's terms at the time of purchase. Refunds are handled as described in our Purchases and refunds policy on this website.
Termination
This agreement ends if you break it. When it ends, stop using DuckCarry and remove it. We may revoke a license key that has been refunded, charged back, shared or obtained fraudulently.
No warranty
To the extent the law allows, DuckCarry is provided "as is", without warranties of any kind. We do not warrant that it works with every phone, camera, card or drive, or that it copies every photo or video.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost data, and our total liability is limited to the amount you paid for DuckCarry.
Governing law
This agreement is governed by the laws of the jurisdiction in which we are established, without regard to its conflict of laws rules. If you are a consumer, you keep the protection of the mandatory laws of your place of residence and may bring claims in its courts.
